Terms and Conditions for AutoShip Service

This is a legally binding document. Read all terms and conditions prior to enrolling in Revival Animal Health’s AutoShip Service. Questions may be directed to customer service at cs@revivalanimal.com.

AutoShip Service Overview

The AutoShip service allows you to schedule recurring orders for specific products on RevivalAnimal.com. These recurring orders shall continue on a schedule set by you (for example, monthly). Before any particular shipment, you shall receive a pre-shipment reminder via the e-mail associated with your RevivalAnimal.com Account.

You may cancel the AutoShip service at any time, except when the cancellation deadline of a particular shipment has passed. Upon cancellation, you will no longer be charged for, or receive, subsequent shipments, except for those you have already paid for or individual orders for which the cancellation deadline has passed.

You may also modify your AutoShip order up to the cancellation deadline of any particular shipment. You may modify which products you receive, the quantity, your shipping address, your periodic delivery schedule, and payment method.

By selecting AutoShip, you authorize us to automatically process and charge your payment method for the selected products on a recurring basis on a schedule set by you.
BY ENROLLING IN AUTOSHIP WITH REVIVAL ANIMAL HEALTH (THE “COMPANY”), YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS:

1. Subscription, Pricing and Billing

1.1. Enrollment. To enroll in the AutoShip service, you must create an account on RevivalAnimal.com and provide accurate and up-to-date billing and shipping information.

1.2. Payment Details. You are responsible for ensuring that your payment method details are current, valid, and have sufficient funds to cover the recurring charges. Failure to keep your payment details up to date may result in termination of your AutoShip order.

1.3. Price. The price of your order is the total of the individual price of each item you order (minus applicable discounts, if any), plus shipping costs and any applicable taxes or fees. The final price of your order shall be given to you upon checkout for your first order. The final price of all subsequent AutoShip orders will be included in the Pre-Shipment Notice sent to you via email. By selecting AutoShip, you agree to allow us to charge your credit card for the order amount.

1.4. Pre-Shipment Notice. Before each shipment, we will send you a Pre-Shipment Notice via the email associated with your RevivalAnimal.com account. The purpose of this Notice is to remind you of your upcoming shipment and provide you with the final price of your shipment. The Pre-Shipment Notice will be sent at least 7 days before your order is processed.

1.5. Modification of Order Prices. We reserve the right to modify the prices for AutoShip products at any time. However, you shall be notified in advance of any price changes affecting your scheduled shipments. This reminder shall be independent of the Pre-Shipment Notice and delivered via the email associated with your RevivalAnimal.com Account.

1.6. Order Authorization and Payment Hold. Approximately twenty-four (24) hours prior to your selected shipment date, your order will be authorized, and a payment authorization hold will be placed on your chosen payment method. Once your order is shipped, your payment method shall be charged for the authorized amount. This authorization hold is not a final charge. The final charge will be processed after your order is shipped. However, this authorization hold may impact the availability of funds in your bank account or on your credit card.

1.7. Final Payment. Your payment method will be charged for the final order price once your order ships.

1.8. Payment Processing Failure. If we are unable to process payment for your order, we will provide you with notification via the email associated with your RevivalAnimal.com Account. Following this notification, you shall have twenty-four (24) hours to add another payment method to your account. Failure to change payment method will result in your order being cancelled. However, your AutoShip subscription shall continue until cancelled by you, even if a single order is cancelled under this section.

2. Order Management

2.1. Account Management. You may manage your account and AutoShip subscription on RevivalAnimal.com.

2.2. Modifying Your Order. You may modify your order frequency, product quantity, and shipping address up to 11:59 PM the day before each scheduled shipment.

2.3. Shipment Errors and Delays. Revival Animal Health is not responsible for any shipment errors or delays resulting from incorrect or outdated information provided by you. It is your sole responsibility to keep your information up to date.

3. Cancellation and Termination

3.1. Shipment Modification. You may pause your AutoShip subscription, change your shipment schedule, or cancel your AutoShip service at any time through your account on RevivalAnimal.com or by contacting our customer support at cs@revivalanimal.com

3.2. Cancelling Your Order. You may cancel an individual order up to 11:59 PM the day before your scheduled shipment. You may cancel your AutoShip subscription at any time, subject to the 11:59 PM deadline for an individual order shipment.

3.3. Final Shipment. If you cancel your AutoShip service after the cancellation deadline for a shipment, , you will still be responsible for and charged for the final shipment.

3.4. Right to Suspend or Terminate Service. We reserve the right to suspend or terminate your AutoShip service without prior notice in the event of a violation of these terms and conditions. However, we shall notify you via the email associated with your RevivalAnimal.com account that we have suspended or terminated your AutoShip service.

4. Limitation of Liability

4.1 Disruption, Delays, or Non-Delivery. We will make every reasonable effort to fulfill your AutoShip orders as scheduled. However, we shall not be liable for any disruptions, delays, or non-delivery of AutoShip products caused by factors beyond our control, including but not limited to natural disasters, transportation issues, supply chain issues, acts of god, government action, shipment delays, or supplier delays.

4.2 Damage. In no event shall we be liable for any direct, indirect, incidental, consequential, or special damage arising out of or in connection with the AutoShip service or its use.

5. Privacy and Data

5.1. Collection of Data. By using the AutoShip service, you consent to the collection, use, and storage of your personal information as outlined in our Privacy Policy.

5.2. Compliance with Law. We will handle your personal information in accordance with applicable data protection laws and take appropriate measures to safeguard your data.

6. Modification of Terms

6.1. Right to Modify. We reserve the right to modify or update these terms and conditions at any time. The updated terms will be posted on RevivalAnimal.com, and it is your responsibility to review them periodically.

6.2. Acceptance of Modification. Your continued use of the AutoShip service after the posting of any modifications constitutes your acceptance of the revised terms and conditions.

7. Litigation Provisions

7.1. Governing Law. These terms and conditions shall be governed by and construed in accordance with the laws of the State of Iowa.

7.2. Exclusive Jurisdiction. Any disputes arising out of or in connection with the AutoShip service shall be subject to the exclusive jurisdiction of the courts of the State of Iowa.

7.3. Agreement to Arbitrate. Any and all controversy or claim arising out of or relating to this Agreement shall be settled by arbitration in the state of Iowa, in accordance with the then-governing rules of the American Arbitration Association. The decision of the arbitrator shall be final and binding on both parties. The prevailing party shall be entitled to recover from the other party the expenses for the arbitrator’s fee, attorney’s fees, costs, and travel expenses, and travel expenses of experts, and for all other expenses of presenting the case. Judgment upon the award rendered may be entered and enforced in any court of competent jurisdiction.

7.4. WAIVER OF RIGHT TO JURY TRIAL. EACH PARTY ACKNOWLEDGES AND AGREES THAT ANY CONTROVERSY THAT MAY ARISE UNDER THIS AGREEMENT IS LIKELY TO INVOLVE COMPLICATED AND DIFFICULT ISSUES AND, THEREFORE, EACH PARTY HEREBY IRREVOCABLY AND UNCONDITIONALLY WAIVES ANY RIGHT SUCH PARTY MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY PROCEEDING DIRECTLY OR IN DIRECTLY ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE TRANSACTIONS CONTEMPLATED BY THIS AGREEMENT.

8. Intellectual Property

8.1 Copyright, Trademarks, Logos, and Service Marks. All content included in or made available through our services, including copyrights, trademarks, logos, and service marks displayed on websites, communication, and applications, are the intellectual property of Revival Animal Health, our licensors and suppliers, and others. Nothing contained in our services should be construed as granting, by implication, estoppel or otherwise, any license or rights to use any intellectual property without the express written permission of Revival Animal Health, our licensors or suppliers, or the third-party owner of any such intellectual property and use of the intellectual property is expressly prohibited. Revival Animal Health’s trademarks may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages Revival Animal Health, its licensors, or its suppliers.

9. Miscellaneous Terms

9.1. Area of Service. Animal Health Revival’s Products are available for shipping within the forty-eight (48) contiguous United States.

9.2. No Assignment or Transfer by Customer; Assignment or Transfer by Company. Your participation in the AutoShip program is personal to you, and you may not assign or transfer your AutoShip subscription or any of the benefits to any third party without our authorization. We reserve the right to assign or transfer your AutoShip subscription.

9.3. Returns. All returns under AutoShip are subject to Revival Animal Health’s return policy.

9.4. Void Subscriptions. AutoShip subscriptions are void where prohibited by law.

9.5. Headings for Reference Only. Headings in this Agreement are for informative purposes only and do not control meaning.
